Tennessee - I'm on mobility. Should I have a power of attorney? The first question you must ask is "Do I need a power of attorney?" If you and your spouse have a joint checking account, your pay is directly deposited into your joint account, and you are not planning on purchasing or selling any large jointly titled items such as a vehicle or a house, then you probably do not need to obtain a power of attorney. However, if you are aware of something of legal significance that could occur while you are away, you should get a special power of attorney for that specific eventuality.
